Health Warranty
This warrranty applies to the Labrador Retriever puppy, herein referred to as the “Puppy” (regardless of age), described in the attached Puppy Sales Agreement; sold by Steve & Darcy Litzinger (Kinderwood Pequenos), the Breeders of Record, herein referred to as the “Sellers” to , herein referred to as the “Buyer(s)”.
The Sellers agree that, even though nothing with living creatures can be 100% guaranteed, they have made every reasonable effort, through extensive pedigree & health clearance research as well as proper socialization & immunization (while Puppy resided at Sellers’ home), to provide the Buyer(s) with a healthy, well-adjusted Puppy. However, even though the Sellers have performed the necessary tasks in an attempt to ensure such things, the Buyer(s) understands that it is still possible the Puppy may not be free of hereditary disorders. With that understanding, the Sellers offer the following warranties to the named Buyer(s) only.
-
We warranty the Puppy to be unaffected by any heritable Eye disorder which severely affects the Puppy’s well being or daily activities for up to 12 months of age. If the Buyer(s) suspects the Puppy has a qualifying Eye disorder, the Puppy must be examined and the condition verified by a certified Canine Ophthalmologist (ACVO) via an OFA (Orthopedic Foundation for Animals) CAER (Canine Animal Eye Registry) exam at the Buyer(s)’s expense.
- We warranty the Puppy to be unaffected by severe Hip Dysplasia and Patellar Disorders for up to 24 months of age. Severe Hip Dysplasia or Patellar Disorder is defined as dysplasia or disorder so severe it affects the Puppy's ability to be a pet on a daily basis. Should the Buyer(s) suspect the Puppy has a severe dysplasia or patellar issue, they must take the Puppy to an orthopedic specialist and have a radiograph (X-ray) performed. The radiograph must then be forwarded for evaluation by OFA (Orthopedic Foundation for Animals). The radiograph must be taken by 24 months of age. The Sellers retain the option of an independent evaluation by an orthopedic specialist of their choice. Should the specialist not agree with the OFA evaluation, another set of radiographs will be taken by the specialist and forwarded to OFA for a second evaluation. The Buyer(s) & Sellers both understand this process may take up to 6 months due to OFA resubmittal regulations.
A copy of all evaluation results must be sent to the Sellers within 10 days of receipt. If any of the above conditions are verified, and the Buyer(s) wishes to keep the Puppy, the Sellers, at their discretion, will refund up to half of the purchase price upon receiving a licensed veterinarian’s letter confirming the Puppy has been spayed or neutered (whichever is appropriate for gender). Otherwise, the Sellers will make every reasonable effort to replace the Puppy with one of approximately equal value (when available) upon the return of the Puppy along with any and all registration materials to the Sellers. In all cases, all veterinary, diagnostic, return, and replacement costs will be the Buyer(s)’s responsibility.
These warranties are dependent upon the demonstration that the Puppy has received adequate care and nutrition. Anything that affects the development or well-being of the Puppy including, but not exclusive to, abuse, neglect, trauma (i.e. inappropriate exercise or activities such as hard hunting, agility, jumping, running or jogging on hard surfaces prior to 18 months of age, etc), being neutered or spayed prior to 18 months of age, undergoing dewclaw removal surgery, or being used for breeding will void these guarantees.
The Sellers have made every reasonable effort, through extensive pedigree and health clearance research, to use sound breeding stock in order to lessen the occurrence of defects considered to be hereditary. While the Sellers cannot guarantee the Puppy will be free of hereditary defects, the Sellers do agree that both the sire and dam of the Puppy were reported to be certified for Hip Dysplasia, Patellar Disorders, known hereditary Eye, and Neurological conditions at the time of the breeding. Copies of those reports have been provided to the Buyer(s) in their “Puppy Packet”.
Both Hip Dysplasia and Patellar Disorders are influenced by hereditary and environmental factors. Poor nutrition, excess weight, and injuries can contribute to these disorders. Therefore, as a condition of sale, the Buyer(s) agrees to follow any nutritional stipulations indicated in the Sales Agreement and to keep the Puppy in good physical condition by allowing said Puppy to exercise only at will. The Buyer(s) further agrees to monitor the Puppy’s weight to ensure that said Puppy does not become overweight. The Sellers will provide the Buyer(s) with a sample of Purina Pro Plan Focus Sensitive Skin & Stomach Salmon & Rice food. This is the food the Puppy is currently accustomed to eating. The Buyer(s) agree to continue to feed the Puppy this food until the Puppy has reached at least 6 months of age. Then, another appropriate Purina Pro Plan formula must be fed until the Puppy reaches 2 years of age. Feeding another food without the express written permission of the Sellers will void all guarantess on the Puppy. “Grain Free” foods should never be fed before 18 months of age. Feeding a “Grain Free” or “Raw” diet before 18 months of age will void all warranties on the Puppy.
The Buyer(s) agrees to monitor the Puppy to ensure it receives proper exercise and also to supervise it in order to prevent injury. Over or under- exercising the Puppy can negatively impact its health. The Buyer(s) agrees to not allow excessive jumping on and off of furniture or stairs as well as to keep the Puppy off of slippery or damp flooring. The Buyer(s) understands that the Puppy will benefit from regular walks and play sessions but also that strenuous exercise and forced activities such as jogging or hunting should be avoided until the Puppy is at least 18 months of age. The Sellers understand that, while sports such as Agility, Coursing, and Hunting are fun to be involved in and offer an opportunity for team work, it is well documented that such activities can do major damage to growing joints. Therefore, the Buyer(s) agrees to avoid such activities until the Puppy is at least 18 months of age. The Buyer(s) further agrees to not allow the Puppy to “roughhouse” with larger and/or older dogs to avoid the occurrence of an injury.
Our “pet” or “companion” puppies are sold with AKC Limited Registration, which makes any offspring of the Puppy ineligible for registration and the Puppy is ineligible for Conformation (“Show”) competitions, and is not to be used for breeding under any circumstances without the Sellers express written permission. The Puppy must be AKC registered and the Puppy’s registered name (in any and all registries) must bear the “Kinderwood” prefix before the Puppy’s registered name in order for any of these guarantees to be valid. The Buyer(s) must also have forwarded a copy of any and all registrations to the Sellers as well as gained the Sellers’ express written approval for registration in other registries besides AKC.
Any "show potentional" puppy is sold exactly as such with absolutely no guarantee of future event or breeding suitability or title made on the part of the Sellers. The Puppy must be AKC registered and the Puppy’s registered name (in any and all registries) must bear the “Kinderwood” prefix before the Puppy’s registered name in order for any of these warranties to be valid. The Buyer(s) must also have forwarded a copy of any and all registrations to the Sellers as well as gained the Sellers’ express written approval for registration in other registries besides AKC.
The Buyer(s) has been provided with the Puppy’s vaccination and worming records and schedules. The Puppy must be vaccinated on the schedule provided in the Sales Agreement with the Rabies vaccine given as close to 6 months of age as possible. The Rabies vaccination must be given at a separate interval than any other vaccination or the Buyer(s) voids any and all health guarantees offered by the Sellers. The Buyer(s) agrees to NOT let their veterinarian vaccinate on any other schedule or they void any and all health warranties offered by the Sellers. The Buyer(s) also agrees to have the Puppy examined by a licensed veterinarian within 5 days of the Buyer(s)’s receipt of the Puppy for these warranties to be valid.
If at any time during the Puppy’s life, the Buyer(s) should become unable or unwilling to properly care for the Puppy, the Buyer(s) must contact the Sellers (we reserve the right of first refusal) so they can assist in the rehoming of the Puppy. The Sellers wish to know where the Puppy is throughout its lifetime.
